Welcome to KitPass. By accessing or using kitpass.club and its community subdomains (the "Platform"), you agree to these Terms of Use. If you do not agree, please do not use the Platform.
KitPass is a free platform that connects families within the same club or school community to pass on sports gear, school kit, and equipment that their kids have outgrown. KitPass does not charge fees, does not facilitate payments, and does not take ownership of any items listed on the Platform. All exchanges are arranged directly between members.
You must be at least 18 years of age to create an account on KitPass. The Platform is intended for use by parents, guardians, coaches, and community organizers. By creating an account, you represent that you are at least 18 years old.
To access community features, you must create an account using a valid email address. You are responsible for maintaining the security of your account. KitPass uses passwordless authentication via magic links — you are responsible for the security of your email account.
You agree to provide accurate information when creating your account and listing items. Your display name (first name and last initial) will be visible to members of your community.
Each KitPass community is a private, gated space accessible only to members who have been provided with a valid access code by a community organizer. Access codes are intended for members of the specific club, school, or organization. Sharing access codes publicly or with individuals outside the intended community is prohibited.
Community organizers are responsible for distributing access codes to their members. KitPass is not responsible for verifying the identity or affiliation of individual members beyond the access code mechanism.
Free only: All items listed on KitPass must be offered for free. KitPass is not a marketplace — you may not list items for sale, barter, or trade. Listing items with the expectation of payment is prohibited.
Accuracy: You are responsible for ensuring that your listings are accurate, including the description, condition, size, and photos. Misrepresenting items is prohibited.
Permitted items: KitPass is designed for sports gear, school uniforms, equipment, books, and related items that children have outgrown. You may not list prohibited items including but not limited to: weapons, hazardous materials, recalled products, counterfeit goods, items that require a license or certification to own, or any items that are illegal to give away in your jurisdiction.
Condition: Items should be in usable condition. Listing items that are damaged, broken, or unsafe is prohibited.
Arrangements: All pickup and exchange arrangements are made directly between members. KitPass does not arrange, facilitate, or guarantee any exchange. You are responsible for your own safety when arranging meetups — we recommend meeting in public locations such as at training, at school, or at other community events.
KitPass provides an anonymous messaging system. Messages are relayed between members without sharing email addresses or other contact details. You choose when and how to share your personal contact information with other members.
You agree not to use the messaging system to send spam, unsolicited commercial messages, harassment, threats, or any content that violates these Terms or applicable law.
Any parent or guardian, club or school official, or member may request a community on KitPass via the request form. KitPass reviews all community requests and reserves the right to approve or reject any request at its sole discretion. Approval of a community does not constitute an endorsement of the organization.
Community organizers are responsible for the appropriate use of their community space and for distributing access codes to legitimate members of their organization.
You agree not to:
Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
List items for sale or solicit payment for items listed on KitPass.
Impersonate another person or misrepresent your affiliation with a community.
Share access codes publicly or with individuals outside the intended community.
Upload content that is offensive, harmful, defamatory, or infringes on the rights of others.
Attempt to gain unauthorized access to other accounts, communities, or Platform systems.
Use automated tools, bots, or scripts to access the Platform or collect data.
Interfere with or disrupt the Platform or its infrastructure.
You retain ownership of any content you post on KitPass, including listing descriptions and photos. By posting content, you grant KitPass a non-exclusive, royalty-free license to display, distribute, and store your content as necessary to operate the Platform.
KitPass does not claim ownership of user-generated content. When you delete a listing or your account, your content will be removed in accordance with our Privacy Policy.
As-is basis: KitPass is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
No endorsement: KitPass does not inspect, verify, or endorse any items listed on the Platform. We make no representations about the quality, safety, or legality of listed items.
No liability for exchanges: KitPass is not a party to any exchange between members. We are not responsible for the condition of items, the conduct of members, or any disputes arising from exchanges.
Safety: While KitPass communities are gated, we cannot guarantee the identity or intentions of all members. Please exercise common sense and caution when arranging exchanges.
To the maximum extent permitted by law, KitPass and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Platform.
Our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid to use the Platform (which is zero — KitPass is free).
You agree to indemnify and hold harmless KitPass and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your content, your violation of these Terms, or your violation of any rights of another person.
You may delete your account at any time through the profile panel or by emailing hello@kitpass.club.
We reserve the right to suspend or terminate your account, remove your content, or restrict your access to any community if we believe you have violated these Terms, at our sole discretion and without prior notice.
We may update these Terms from time to time. If we make material changes, we will notify you via the announcement bar on KitPass or by email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in New York, United States.
